Is it a wise decision to let someone periodically confirm he isn’t a driver?

The Pokemon Go app add in the latest update a requirement that as soon a device is exceeding a certain speed the user has to periodically confirm he isn't the driver but just a passengeer.

I can understand that it isn't a good thing to motivate to be playing while driving. But isn't this counterprogressive?

They had beforehand (and still) a notification noting you shall not play while driving.

Thoose who don't care and do it anyway simply would click periodically they aren't the driver, while they drive. What is nothing but an additional distraction. So does this solve any problem at all, or just making the problem more problematic?
